Payment

A non-refundable deposit (booking fee) of 20% is required to secure all photography bookings. The remainder of the balance is payable 28 days before wedding bookings and 10 days before any portrait bookings.


Cancellation and changes

Clients are entitled to a full refund of the deposit if the booking is canceled within 7 days of booking. Any cancellation after this time will result in a loss of the booking fee. All cancellations must be made in writing (email recommended). If you wish to reschedule the booking, the booking fee will be carried over at the discretion of Jason Barrett Photography and subject to availability. In the unlikely event that Jason Barrett Photography is unable to attend on the day, we reserve the right to appoint another photographer to attend on our behalf, to undertake the wedding photography to the best of their ability. Should a replacement be unavailable, all monies paid will be refunded in full.
In the event of any changes to plans including dates, times, and venue, it is the responsibility of the client to notify Jason Barrett Photography immediately.

Display

Jason Barrett Photography may display any images covered by our contracts for promotion in studios, websites (including blogs and social networking sites), portfolios, literature, display areas, exhibitions, competitions, advertising, slide shows, or commercially, as long as images are used lawfully and without damage to the client.
ImagesAll image sizes are nominal. The photographer will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibers. It is sometimes impossible to record digitally the exact colour seen by the human eye. The photographer will retake a shot if a subject has been seen to blink. However, it is impossible to guarantee to spot every blink, especially in group shots.


Retouching and editing

The photographer may retouch, digitally manipulate, and finish according to his/her discretion. Further retouching, digital manipulation, and finishing requested by the client are available as an optional extra and may incur additional charges.

Copyright

Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files, or printed documentation relating to such images are protected by the Copyright and Design Act 1988 and remain the copyright of Jason Barrett Photography.
It is contrary to the Act to copy or allow to be copied photographically, electronically, or by any other means an image created as part of a contract without the written permission of Jason Barrett Photography.
It is understood, however, that if a disc of your images is purchased as part of your contract, the client has the right to reproduce the images for personal use.

License and Coverage

Jason Barrett Photography shall be granted an artistic Licence in relation to the poses photographed and the locations used. Photograph location, poses, and number of images taken are at the discretion of the photographer. The client is expected to meet with the photographer and visit the venue before the wedding to determine the preferred photography style and shot list, and to allow the photographer to assess lighting conditions/environment which can contribute to the quality of images.The photographer will endeavor to fulfill the requirements of the client. However, due to the unpredictability of factors such as weather, willingness, and cooperation of subjects, it may be impossible to capture all the images requested.
For bookings involving a church ceremony or at certain other venues, photographers’ movements are sometimes restricted by the minister or official in charge. Photographing of parts or even all of the ceremony may be restricted or prohibited, as may the use of artificial lighting. The photographer cannot accept responsibility for limited coverage in such cases.

Force majeure, Act of God, and limitation of liability

The due performance of the contract is subject to alteration or cancellation by either party owing to any cause beyond their control (e.g. sudden illness, injury). In the unlikely event of a total photographic failure or cancellation of the contract by either party or in any other circumstance, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.

Digital files

Digital files remain the property of Jillian Hartley Photography. The photographer will not be solely responsible for the storage and maintenance of digital files but will keep them intact and available to the client for at least one year from the date of the wedding.

Complaints

Any complaints should be raised by the client in writing to Jason Barrett Photography within 14 days from receipt of images.

Insurance

The client(s) are advised to take out an insurance policy to cover any expenses in the event of a cancellation.
